How to apply for New York marriage license

How to Apply

If you’re ready to get your marriage license in New York, you’ll have to find a day where the two of you can go together in person. New York requires couples to apply in person to any town or city clerk in the state. When you visit the city clerk, the marriage license application must be signed by both of you.

Before you go, make sure both of you bring a document that proves your date of birth. These documents could be a birth certificate, baptismal record, naturalization record or census record.

You’ll also have to bring documents that establish both of your identities. These could be a driver’s license, passport, employment picture ID, or immigration record. Don’t forget to check with your specific city clerk’s office — it may have its own set of requirements.

Requirements

In New York, both applicants must be 18 years of age or older. Once you receive your marriage license, it can only be used within New York State. So make sure you think through where you want to hold your pop-up wedding or elopement before applying for a marriage license!

Once you receive your license, the marriage ceremony is only valid if it is performed by the individuals listed in section 11 of the New York State Domestic Relations Law. These include a member of the clergy, a town or county justice, and many others. View a full list of accepted individuals.

Cost

If you receive a marriage license by a town or city clerk in New York State outside of the city, it costs $40. The price may vary based on whether you’re proposing in the heart of New York City or a town outside the city. Check out the New York City Marriage Bureau’s website for more details.

Expiration

The good news is, you’ll be issued your marriage license immediately (so make sure there’s no chance you’ll change your mind!) However, your ceremony can’t take place until 24 hours after the license was issued.

Make sure you plan carefully, though. A New York marriage license is only valid for 60 days after it’s issued.
